Fulton County District Attorney Fani Willis, the Georgia prosecutor investigating Donald Trump’s efforts to overturn the 2020 election results, said that Trump’s claims of legal immunity won’t protect him from prosecution in a state case.
During an interview on CNN, Willis was asked about the prospect of Trump claiming presidential immunity would prevent her from filing criminal charges against him.
“Have you given any thought to cases that essentially what you do as president is protected because you’re the president doesn’t amount to a crime?” CNN’s Sara Murray said.
“Of course, I’ve given thought to it that that may be raised as a legal issue,” Willis replied before declaring that “that protection will not prevent a prosecution if that becomes necessary in this state case.”
Willis has been investigating Trump for nearly a year after the publication of audio from a phone call when Trump attempted to convince Secretary of State Brad Raffensperger to overturn the 2020 election.
The comments from Willins are a signal that an indictment against the former president could be around the corner.
During the same segment, CNN’s John Berman interviewed lawyer Michael Moore, who served as the U.S. Attorney for the Middle District of Georgia.
Moore said that Willis has the evidence to indict Trump and could criminally charge him now. But the prosecutor is pursuing a more expansive case that will take longer, according to Moore.
