Donald Trump’s nominee to lead America’s intelligence community found himself trapped by one of the simplest questions imaginable: Who won the 2020 presidential election?

Instead of giving the obvious answer, Jay Clayton repeatedly dodged the question during his Senate confirmation hearing, eventually sitting in silence as senators accused him of refusing to acknowledge reality to appease President Trump.

The most striking exchange came when Sen. Jon Ossoff (D-Ga.) asked Clayton a direct question.

“Who won the 2020 election?” Ossoff asked.

“I’m not going to do this with you,” Clayton replied.

Ossoff reminded Clayton that the hearing was effectively a job interview for one of the nation’s most sensitive national security positions.

“This is a job interview,” Ossoff said. “You have an obligation to be honest and forthright with the committee, yes?”

But Clayton still refused.

“Like I said, I’m not gonna get into that with you,” he answered.

As Ossoff continued pressing him, Clayton stopped responding altogether, creating an awkward silence that quickly became one of the hearing’s defining moments.

“You refuse to answer a basic question about who won a presidential election, but you ask to lead America’s intelligence community?” Ossoff asked. “Isn’t it humiliating to be unable to answer this question? To have to indulge the president’s delusions?”

Clayton had no response.

The exchange immediately raised fresh questions about whether Trump’s nominee would be willing to tell uncomfortable truths if confirmed to oversee the nation’s intelligence agencies.

The issue resurfaced later when Sen. Angus King (I-Maine) gave Clayton another opportunity to answer.

“I’m just asking a really simple question,” King said. “Who won the 2020 election?”

Rather than answer directly, Clayton repeated that Joe Biden “was certified as the president” and that the country “went through our electoral process.”

King wasn’t buying it.

“That’s not an answer to the question,” he replied.

Clayton insisted he had answered.

“I think I’ve answered it many times.”

King disagreed.

“You have not answered it,” the senator said. “Saying ‘Joe Biden was certified’ is not an answer.”

By the hearing’s end, even Senate Intelligence Committee Vice Chairman Mark Warner (D-Va.) expressed frustration after multiple attempts to get Clayton to acknowledge the election results plainly.

“I’ve known Mr. Clayton for some time,” Warner said. “But I am bitterly disappointed. We’ve tried umpteenth different ways to gift you the ability to just acknowledge that Joe Biden was the president…”

Clayton responded that he had acknowledged Biden was president.

Warner added the key point Clayton had repeatedly avoided.

“…and fairly and duly elected.”

Only then did Clayton finally say, “…and fairly and duly elected, under our process.”

The hearing also featured tough questioning over Clayton’s lack of intelligence and national security experience, as well as his role in approving subpoenas targeting New York Times journalists. But his repeated refusal to answer a straightforward question about the 2020 election ultimately became the hearing’s defining moment.
