Derrick Evans, a newly elected West Virginia lawmaker, was charged this week for participating in the violent takeover of the U.S. Capitol.

According to reports, the Justice Department filed unlawful entry charges Friday against the West Virginia Republican after he filmed himself and other supporters of Donald Trump storming the Capitol to protest President-elect Joe Biden’s election win.

Evans was among at least six state legislators from seven states who took part in the Capitol riot that left one police officer and four demonstrators dead, and injured scores of other law enforcement officers.

Evans claims that he committed no criminal acts by breaking into the Capitol and refused to resign.
