Former Attorney General Eric Holder issued a stark warning Wednesday, expressing deep concern that the Supreme Court could deliver a “dangerous” ruling favoring former President Donald Trump’s claim of presidential immunity. Holder’s apprehension stems from what he perceives as a delayed decision from a court increasingly leaning towards the extreme right.
Trump seeks immunity from federal charges related to storing classified documents at his Mar-a-Lago residence and allegations linked to the 2020 election and the January 6 Capitol riot. A ruling is anticipated before the month’s end.
In an interview on MSNBC’s “Deadline: White House” with Nicolle Wallace, Holder suggested that some justices might entertain the idea that criminal laws could be skirted if actions were taken in an official capacity.
He emphasized that “the notion that some justices are fooling around with the idea that a president could violate criminal laws in his official role is absurd and dangerous.”
“You know, wait a minute, a president can violate the American criminal law, if he or she is doing something in their official capacity. That is an absurd and dangerous conclusion,” Holder said. “And I’m worried, given the length of time that it has taken for the Supreme Court to decide this case, that something along those lines might come out of the Supreme Court.”
Holder emphasized the critical need for the Court to assert that presidents are accountable under law like any other citizen. “Anything less would be absurd,” he stressed.
Trump and his legal team argue for broad immunity for presidential actions.
The Supreme Court’s upcoming decisions on Thursday and Friday hold significant weight, although their specific rulings remain uncertain.
Some analysts, including vocal Trump critic and conservative attorney George Conway, anticipate a decisive rejection of Trump’s immunity claims.
“I do trust the court on this. I think … Donald Trump is going to lose. I think he’s going to lose big,” Conway stated recently on CNN. “I think there may be a few wrinkles in the opinion that may add a few steps to the process, but at the end of the day, I don’t think his argument is going to fly.”
The outcome of this case could reshape presidential accountability in American law.
