Supreme Court Justice Clarence Thomas has not shown up to work since he was admitted to Sibley Memorial Hospital in Washington on Friday after experiencing “flu-like symptoms,” and he was diagnosed with an infection. But the Court is declining to say whether the 73-year-old Justice remains in the hospital after saying that he would be released by Monday.

The court released a statement on Sunday saying that Thomas’ symptoms were “abating,” and that he was expected to be released Monday or Tuesday. But Thomas was not been present in court for the past two days and court spokeswoman Patricia McCabe said she had no update to provide, The Associated Press reported via HuffPost.

The court heard arguments Wednesday morning and Chief Justice John Roberts said, adding that Thomas was “unable to be present today” without explanation.

Thomas’ absence from arguments comes as the Senate Judiciary Committee is holding confirmation hearings for resident Joe Biden’s nominee Judge Ketanji Brown Jackson.

Thomas was being treated with intravenous antibiotics, the court has said.
